Dow ADR recognizes that lawyers and parties have busy and fluid schedules, and that there are situations beyond everyone’s control. Often, despite everyone’s best efforts, the parties may not be ready to mediate, or the case may settle prior to mediation or arbitration. Dow ADR does not charge a cancellation mediation or arbitration fee if Mr. Dow is advised of the cancellation no later than ten (10) days prior to the start of a scheduled mediation or arbitration. If the mediation or arbitration session is cancelled (and not reset) within ten (10) days prior to a confirmed scheduled mediation or arbitration, each party shall be responsible to Dow ADR for seventy-five percent (75%) of the cost of the scheduled session.
